General Terms & Conditions (GTC)
The website www.biomatra.ch is the property of the company Mathis Trading GmbH, located in Canton of Lucerne, Switzerland with address: Wiggenhalde 11, 6010, Kriens. This website is also operated by Mathis Trading GmbH, which is also the controller within the meaning of the EU General Data Protection Regulation (hereinafter the "GDPR"). The contractual partner and operator of the online shop is Mathis Trading GmbH.
No data protection officer has been appointed at the controller because the legal requirements for a mandatory appointment do not exist. However, enquiries about data protection and the use of your personal data can be sent to the following e-mail address and will be handled by us in accordance with the legal requirements:

The website provides its services to visitors or customers only with their acceptance of all the following General Terms and Conditions. The personal data collected will be used in accordance with the privacy contract.
By visiting the website or making purchases through it, you automatically accept these terms.

1. Access to our website
Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our website without notice (see below). We will not be liable if for any reason our website is unavailable at any time or for any period. It is your responsibility to take all necessary steps so that you can access our website. You are also responsible for ensuring that all persons accessing our site through your internet connection are aware of these terms, and that they comply with them. It is possible to register on our site with a user account. In this case you will choose a username (email address) and password. You will be responsible for keeping your username and password safe and preventing unauthorized access to your account. You are responsible for ensuring that the information you provide is correct, complete and not inappropriate in any way. You agree to notify us immediately of any changes to the information you provided when you registered.
When you subscribe to receive the company's newsletter there is the possibility to receive news, information about new products, updated prices, additional discounts, etc.
2. Purchase Orders and Contract agreement
The items and prices in the online shop do not constitute a legally binding offer for sale. The offer is valid as long as the product is visible in the online shop. By placing an order for the items contained in the shopping cart, the customer submits a binding offer to purchase. The customer receives confirmation of receipt of the order in an automated email. The purchase contract is only concluded with the written confirmation of dispatch from Mathis Trading GmbH , subject to availability and correct pricing, including the cost of delivery of the goods to the address specified. The valid contract of sale shall be deemed to be the correct completion of our online order form and acceptance of our GTC. In the case that the customer wishes to purchase a large quantity of products and has contacted Mathis Trading then Mathis Trading reserves the right to apply additional discounts, contracts, annexes which negotiate the terms of sale, dispatch and delivery and are subject to additional agreements.
3. Pricing Information
All prices in the online shop are quoted in Swiss Francs (CHF) exclusive of statutory VAT. We reserve the right to change our prices at any time. In the event of an incorrect price being quoted, Mathis Trading reserves the right to inform the customer of this prior to dispatch of the goods in order to negotiate a price adjustment or cancel the order. Shipping and packing costs are charged in addition to the purchase price and are indicated during the order process. The customer bears all shipping and delivery costs for the ordered goods. In the case that the customer wishes to purchase a large quantity of products and has contacted Mathis Trading then Mathis Trading reserves the right to apply additional discounts, contracts, annexes which negotiate the terms of sale, dispatch and delivery and are subject to additional agreements.
4. Payment methods
The purchase price, as well as the shipping and packaging costs of the goods, shall be due in the currency indicated and immediately after shipment of the order. The customer shall pay the total amount due via credit / debit card (VISA, Eurocard, Mastercard, American Express, etc) or TWINT and shall enter the respective credit / debit card information on customer’s device. For your security, encryption is used. Your personal data such as credit card number, expiry date and CVV2 / CVC2 card security code are not stored on our server. If an authorization cannot be obtained, the online shop www.biomatra.ch, shall have the right to promptly reject customer’s order. It is possible to pay by bank transfer after further agreement and authorization from Mathis Trading GmbH, and payment must be made within 7 days from the date of agreement. In the case of delay or non-payment within this period, the laws in force in Switzerland apply.
Invoices for purchases shall be due within (5) working days after the order is placed.
5. Availability
The products that are in stock are marked as " in stock " in the online shop. Orders are processed within 3 working days of receipt by Mathis Trading GmbH. During weekends and public holidays no dispatch is made.
If the products are no longer available or are incorrectly marked as " in stock ", the customer will be notified by email or telephone and a new expected delivery date will be agreed. Mathis Trading will endeavour to deliver these goods as soon as possible at no additional delivery cost.
If the goods are no longer available, cannot be purchased or manufactured and the customer has already paid Mattis Trading will refund the payment made by the customer .
In the event that Mathis Trading is unable to deliver or ship the goods within 30 calendar days of receipt of the order (excluding special orders), the customer has the right to cancel the contract. The customer will receive a full refund of the payment already made for that item. The customer shall have no further claim against Mathis Trading.
If the customer provides incorrect details in the order (wrong delivery address) additional delivery costs will be borne by the customer.
In the event that the customer does not accept the goods shipped within the agreed delivery period or the delivery period specified by the supplier, Mathis Trading GmbH may withdraw from the contract. As a consequence, the order will be cancelled and the customer will be charged a handling fee of 20% of the invoice amount, but not less than CHF 20. The expense of returning the goods to Mathis Trading is borne by the customer.
Any products that are not listed in the online shop, as well as products that have a delivery period of more than 30 calendar days, are subject to additional agreements and contracts between Mathis Trading GmbH and the customer. These additional agreements could be in written or oral form provided.
6. Acceptance of goods received
Delivered or collected goods must be inspected by the customer immediately upon acceptance for completeness, correctness and transport damage. If any defect exists, Mathis Trading must be informed in writing within 2 working days of receipt of the goods. The goods must be in their original, undamaged condition before being returned to us.
7. Liability Exclusions and Warranty
Mathis Trading sells its own products under the trade name BIOMATRA and Mathis Trading reserves the right to sell products under other trade names and manufactured by third parties. Mathis Trading does not assume any warranties related to the quality of the products from the manufacturer, as well as the ingredients used in the products, the description of the products from the manufacturer, packaging, quantity.
Mathis Trading GmbH has no influence on the performance and reliability of third party products or on the warranty services of other manufacturers. The respective manufacturer's warranty conditions apply to the extent that they are valid in Switzerland.
No warranty claims can be made for damage caused by improper use of the products, defects due to external factors (natural disasters, moisture, sun, high or low temperatures), defects caused by falling and/or impact, or defects caused by mixing and/or modification with other products as well as transfer of the contents of the products to other packaging.
The customer may not claim warranty for damages that did not occur to the products themselves. This may include indirect and consequential damages such as lost profits, unrealized savings or damages resulting from delayed delivery. Additionally, Mathis Trading is not liable for damages caused by improper storage.
The customer can only make a warranty claim by presenting a purchase contract.
In the event of defects, the customer's rights are limited to requiring replacement shipments or a reduction in the purchase price. The customer does not have these rights in the case of minor defects. Incidentally, any warranty is excluded by our company to the full extent permitted by law.
The product information provided on biomatra.ch is not binding. The online shop is entitled to change this information at any time. Furthermore, quality standards, information on sources, samples and samples of products are not binding and may be changed at any time.
Mathis Trading accepts no liability for errors in figures, prices, copies or due to late delivery or non-delivery.
By handing over the goods to the transport company, Mathis Trading fulfils all the following obligations towards the customer arising from the purchase order, and the right of use as well as the risk is transferred to the customer. The company shall not be liable in the event that the goods are not handed over directly to the customer by the transport company, but are left outside by the transport company in the absence of the customer or are handed over to a third party , etc.
8. Withdrawal / Return
The customer has the right to return all or part of an order within all of (14) calendar days from the date of receipt.
Please, complete our Cancellation Form* and send it to us.
The right of withdrawal is provided for in articles 3e to 3a of Law 2251/1994 but does not apply in the following cases:
-citing grounds
-the goods have been used
-the goods are not in their original packaging and in perfect condition.
- in the supply of goods which may be spoiled or expire soon.
-In the supply of sealed goods which are not suitable for return, for health protection or hygiene reasons, and which have been unsealed after delivery,
- the supply of goods which, because of their nature, are, after delivery, inseparably mixed with other items.
The return of goods shall be deemed a revocation of the purchase order. The customer shall return the goods at customer’s own risk, liability and expense.
Please clarify that the maximum return period for a replacement cannot be extended beyond fourteen (14) calendar days.

In the event that any of the products you have received are defective the client needs to complete our Cancellation Form* and send it to us, as soon as possible but no longer than 48 hours after receiving the goods. The customer shall return the goods within (14) calendar days and all transport cost are at the expense of Mathis Trading GmbH.
The deadline is deemed to have been met if you send back the goods before the end of the period.
Refunds to the customer are made within (14) working days after receiving the goods at our address.
10. Security and Data Privacy
Compliance with data protection regulations is of particular importance to us. The aim of this data protection declaration is to inform you about the type, scope and purpose of the processing of personal data and the rights that exist for you, insofar as you are a data subject as defined by Art. 5 lit. Art. 5 lit. b Swiss Federal Law on Data Protection (DSG) or Art. 4 No. 1 of the EU General Data Protection Regulation (DSGVO). This data protection declaration applies to the website with the Swiss top-level domain "www.biomatra.ch" of the Mathis Trading GmbH. If the website with another country-specific top-level domain is accessed, both data protection declarations apply if the website is accessed from Switzerland.
Online shop biomatra.ch shall archive the personal customer data required for the processing orders.
Customer payments made in our Online-Shop are made in a protected area, in which data is transmitted in an encrypted manner. Online store is not in a position to assume any liability for the security of the transmitted data.
Any and all image, material used by biomatra.ch is protected by applicable copyrights and may be used by the customer only subject to our store’s prior consent.
The web server temporarily records the connection data of the requesting computer (IP address), the pages you visit on our website, the date and duration of the visit, the identification data of the browser and operating system type used as well as the website from which you visit us and the successful retrieval in log files. The technical administration of the websites and anonymous statistical surveys enable an evaluation of the access to our website and an analysis with the aim of increasing the data protection and data security in our enterprise, and ultimately ensuring an optimal level of protection for the personal data we process.
The data of the server log files are stored separately from all personal data provided by you for analysis purposes for 12 months and then deleted.

When you register for an e-mail newsletter, our shop requires your e-mail address to which the newsletter is to be sent. Any further information is voluntary and will be used to address you personally and to personalize the newsletter as well as to clarify any queries regarding the e-mail address.
If you register for the newsletter on this website, we will use the data you enter exclusively for the purposes stated in the newsletter registration or to inform you of relevant circumstances regarding this service or its registration. Our online shop has concluded a contract with its email marketing service provider.

We do not accept any liability for such websites and their content, nor for the products or services offered on such websites, nor for other offers made, nor for compliance with data protection regulations. Our online shop distances itself from such websites. Website visitors activate such links at their own risk. 12. Copyrights / Commercial Property Rights
The content of this website is subject to commercial property rights, such as copyright and trademark law. Printouts or electronic copies may only be used for information for private personal use. Reproduction for other purposes and in particular commercial use is not permitted. Any use of the contents of Shop Natural website, such as texts, images, logos, graphics, sound recordings, animations and videos etc., that goes beyond information for private personal use is only permitted with our written consent. 12. Governing Law and Place of Jurisdiction
The legal relationships between customers and Mathis Trading GmbH shall be governed exclusively by Swiss material law subject to the exclusion of the purchase rights agreed upon in the Vienna Convention. The place of jurisdiction shall be Lucerne, Switzerland.
13. Effective Date
These GTC shall be effective as of March 18, 2025.
