1. Scope of application

These General Terms and Conditions (“GTC”) govern all sales and deliveries of Biomatra® products by Mathis Trading GmbH (“we” / “our”) to private and business customers via our online shop, by e-mail, or by other agreed channels. Our online shop is primarily intended for standard product purchases by private and business customers. Business customers (companies, retailers, distributors, hotels, gyms, etc.) may additionally request special conditions, bulk pricing, samples or customised offers via our dedicated B2B pages or contact form. By placing an order, the customer accepts these GTC.

2. Minimum order quantity and samples

There is no minimum order quantity for standard online purchases unless expressly stated on the product page. Minimum order quantities may apply to certain products, packaging units, or B2B offers and will be clearly indicated in the online shop or in a written offer. Free product samples are available exclusively for business customers upon written request and subject to our prior written approval. Approved samples are accompanied by the relevant Safety Data Sheet (SDS) in the language(s) required by the customer (DE, FR, IT, EN), in accordance with Swiss law.

3. Customer inquiries

The contact form on www.biomatra.ch may be used to request: (i) general information about our company and products; (ii) special offers / price quotations; (iii) information about product quality, packaging, quantities, product use; (iv) requests for samples (business customers only); and (v) SDS requests (business customers).
We normally respond to such relevant inquiries within 24 hours on working days. We will not respond to inquiries that are not related to our store, products or production. All responses are non‑binding unless confirmed in a formal written offer or order confirmation.

4. Large‑volume orders and international deliveries

For bulk or large‑volume orders, customers must contact us directly for a special written offer covering product selection, packaging, price, payment terms and delivery conditions.
Delivery outside Switzerland and Liechtenstein is possible only by prior written agreement and on the basis of such an offer, taking into account local import regulations, duties and logistics costs. International deliveries will be carried out only after both parties have accepted the written offer and payment terms.

5. Prices and payment

All prices shown in the online shop are final prices in CHF. Mathis Trading GmbH is currently not registered for Swiss VAT (MWST). Accordingly, no Swiss VAT is charged or shown on invoices in accordance with the applicable provisions of Swiss law. Payment is due immediately at checkout via the payment methods offered (credit and debit cards via Wix Payments). TWINT is not accepted. Bank transfer is available only upon prior request and after our written confirmation. Orders paid by bank transfer are dispatched only after full receipt of cleared funds.
Orders are processed only after full payment has been received. We reserve the right to change prices at any time; the price applicable is the one displayed at the time of order. For international or EU customers, prices may be offered in EUR upon request and only on the basis of a separate written quotation and agreement. All orders, including pick-up and international deliveries, must be paid in advance unless otherwise agreed in writing.
For private customers, the prices and payment options displayed in the online shop at checkout are binding.

6. Shipping, delivery & fulfilment

Standard dispatch times for online shop orders are indicated on the product page or during checkout. Some products may be manufactured or supplied to order, which can result in longer dispatch times. For bulk orders, special packaging, or customised B2B orders, dispatch times are agreed individually in writing.

7. Product use and compatibility

Biomatra® probiotic products contain live beneficial microorganisms. They must not be used together with conventional chemical cleaners, disinfectants, bleach, or strong acidic/alkaline products, as such substances may inactivate the probiotic bacteria and impair cleaning or odour‑neutralising performance. We accept no liability for reduced performance or adverse effects resulting from combined use with incompatible products or failure to follow usage instructions.

8. Safety Data Sheets (SDS)

Mathis Trading GmbH provides up‑to‑date SDS for all Biomatra® products in accordance with Swiss ChemO / ORRChem and EU REACH / CLP: (i) at or before the first delivery to business customers; (ii) on request by distributors, professional users, or authorities; and (iii) for approved samples for business customers, in the language(s) requested by the customer (DE, FR, IT, EN as needed). Customers must comply with all SDS instructions for handling, storage and disposal.

9. Customer health and allergic reactions

Biomatra® products contain no substances that require hazard pictograms under Swiss or EU law and are safe for their intended use. Nevertheless, individual sensitivities or allergic reactions cannot be completely excluded.
Customers must follow product‑label and SDS instructions. In case of a suspected reaction, the customer must discontinue use and inform Mathis Trading GmbH immediately, providing product name, batch/lot number and circumstances. We will investigate the case and, if required by law, notify the competent Swiss authority.
Liability is limited to cases of defective product or proven breach of duty by Mathis Trading GmbH. We accept no liability for reactions due to improper use, disregard of instructions, or individual hypersensitivity.

10. Returns and complaints

Statutory consumer rights for private customers, including mandatory withdrawal or warranty rights under applicable law, remain unaffected. Returns require our prior written approval. Goods must be checked immediately upon receipt; defects must be reported in writing within 7 days. If a complaint is justified, we will replace the goods or issue a credit note. Further liability is limited to statutory provisions.

11. Liability

We are liable only for damages caused by gross negligence or intent. Liability for indirect or consequential losses (including lost profits or delays) is excluded to the extent permitted by Swiss law. We accept no liability for improper handling, storage or resale.

12. Intellectual property

All product designs, logos, trademarks, texts and images on www.biomatra.ch are the intellectual property of Mathis Trading GmbH. Any reproduction, distribution or commercial use without prior written permission is prohibited.

13. Data protection

We process personal data in compliance with the Swiss Federal Data Protection Act (DSG) and the EU GDPR. Data collected during orders or inquiries is used solely to process orders and fulfil contracts. Data will be disclosed to third parties only where legally required or necessary for logistics, customs or payment processing. Customers may request information, correction or deletion of their data by contacting info@biomatra.ch.

Our website uses certain third-party tools provided via the Wix platform (e.g. Easy Language Translate, Mega Content Protector) for technical functions. Where such tools process data, the respective provider’s privacy policy applies. Customers can contact us at info@biomatra.ch for further information about these providers.

14. Governing law & jurisdiction

All contracts are governed by Swiss law; the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. Place of jurisdiction: Lucerne, Switzerland. Mandatory consumer‑protection rights for EU private customers remain unaffected.

15. Third‑party services

We may use third‑party manufacturers or logistics partners to fulfil orders. While we select such partners carefully, we cannot be held liable for their performance except where required by Swiss law.

16. Force majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, epidemics, strikes, supply‑chain disruptions, transport delays or government restrictions.

17. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising in connection with a specific order is limited to the net value of the goods supplied. Liability for consequential or indirect damages is excluded.

18. Retention of title

All delivered goods remain the property of Mathis Trading GmbH until full payment has been received. We are entitled to register the retention of title in the official Swiss register at the customer’s expense.

19. Severability

If any provision of these GTC is held invalid or unenforceable, the remaining provisions remain in effect; the invalid provision will be replaced by a valid provision that best reflects the intended purpose.

20. Export compliance

Customers are responsible for compliance with local laws and regulations when importing, reselling or using our products outside Switzerland. We accept no liability for misuse or non‑compliance with foreign regulations.

21. Order cancellation

After our written order confirmation, the order is binding. Cancellation or changes require our prior written consent. If we accept cancellation, the customer bears all costs incurred plus a cancellation fee of 20 % of the net order value. For B2B customers cancellation fee of 20 % of the net order value (minimum CHF 100). If goods have already been shipped, cancellation is excluded. We reserve the right to claim higher actual costs if they exceed the cancellation fee.

22. Amendments

We may amend these GTC at any time. The version published on www.biomatra.ch at the time of order applies.

23. Effective date

These GTC enter into force on 24.01.2026
